Texas bar-hoppers arrested for jaywalking left 11-month-old baby locked in car, police say

Austin, Texas — Three people arrested for jaywalking and resisting police in downtown Austin allegedly failed to tell officers that an 11-month-old baby was still locked inside the car they arrived in, according to court documents and police reports.

The suspects — Gabrielle Aleman, 22; Isaiah Calvo, 25; and Jaslyn Tovar, 21 — were taken into custody late on December 15 after officers with the Austin Police Department nearly struck them while they were standing in the roadway instead of using a crosswalk.

Police stop escalates into arrests

According to court records tied to the pedestrian violations, officers observed the trio in the street and described them as appearing “oblivious to their situation.” When police asked them to move toward the sidewalk, the group allegedly refused to comply.

Officers eventually caught up with the three, at which point Aleman and Tovar allegedly resisted arrest, physically struggling with police. Authorities say Aleman ran approximately 20 feet before being detained, while Tovar allegedly flailed on the ground as officers attempted to handcuff her. Calvo reportedly sat on the curb during the incident.

Police noted that Aleman and Calvo appeared intoxicated, citing slurred speech, a strong odor of alcohol, bloodshot eyes, and unsteady footing.

Baby left undisclosed during arrest

At no point during the initial encounter or arrest did any of the suspects inform officers that a baby had accompanied them, police said.

The situation came to light only after the three were booked into the Travis County Jail.

At 1:09 a.m., police received a phone call from Aleman’s aunt, who told officers that Aleman’s 11-month-old son was still inside her parked vehicle. Court documents describe the car as being located in a high-crime area.

When detectives questioned Aleman inside the jail, she allegedly told them the baby was with her sister in a neighboring town — a statement police later determined was false.

Infant found trapped in dangerous position

Officers located the car at 1:23 a.m., where a concerned citizen had already spotted the baby inside. According to the arrest affidavit, the infant was found pinned under the front passenger seat, trapped in a dangerous degree of positional stress due to an unsecured car seat.

Police said the outside temperature had dropped to 36 degrees Fahrenheit, and the baby was not dressed appropriately for cold weather. The child was transported to a hospital for evaluation and was not injured, authorities confirmed.

Surveillance footage contradicts suspects’ claims

Investigators reviewed surveillance footage from bars along Austin’s Sixth Street, which reportedly showed the three suspects bar-hopping from 9:56 p.m. until their arrest at 11:42 p.m.

According to police, the suspects later admitted they planned to monitor the baby through FaceTime while they went out drinking.

Charges and court dates

All three suspects were charged with child abandonment/endangerment with imminent danger of bodily injury or death, along with traffic-related misdemeanors stemming from the jaywalking incident.

As of Tuesday, none of the suspects was listed as an active inmate.
Calvo and Tovar are scheduled to appear in court on January 9, 2026, while Aleman’s court date is set for January 16, 2026.

Ongoing investigation

Authorities have not released additional details about child protective services involvement or whether further charges could be filed. The incident remains under review as prosecutors prepare for upcoming court hearings.
