Man Accused of Fatally Shooting Father During Argument in Milwaukee Gangway

Milwaukee, WI – A family dispute that escalated into deadly violence has left a 55-year-old man dead, his 28-year-old son charged with first-degree homicide, and a witness caught between her past and present relationships as she watched the confrontation unfold.

Authorities say Miguel Ocasio shot and killed his father, Miguel Arocho, during an argument outside a South Side residence on Nov. 13, according to newly filed court records. The shooting happened in front of a witness who is both Ocasio’s ex-girlfriend and Arocho’s stepdaughter, adding a complicated dynamic to the deadly encounter.

The Milwaukee Police Department responded around 7:45 p.m. to the home in the 1900 block of South 16th Street, where they found Arocho suffering from a gunshot wound to the head. He was pronounced dead at the scene.

Witness Details a Chaotic Confrontation

According to the criminal complaint, the witness told police she and her children had been living with Arocho at the time. She identified Ocasio as both her former boyfriend and Arocho’s biological son, telling investigators she saw the entire confrontation unfold.

Earlier that day, she had returned home from a trip to Walmart with a male friend. When they arrived, Ocasio allegedly pulled up and began accusing her of being romantically involved with the man who had given her a ride.

She told officers she got out of the vehicle because she knew Ocasio “carries a gun” and wanted to protect her friend.

“They were standing near the side door and her ex pushed her in the face with his hand,” the affidavit states.

Arocho, hearing the argument, came downstairs. The three ended up in the gangway, where tensions escalated rapidly.

Gunfire Erupts After Escalating Tensions

Investigators wrote that the witness tried to defuse the situation, but Ocasio allegedly pulled out a firearm. She attempted to push him away toward the sidewalk, where he fired two shots, which she believed did not hit anyone.

Arocho briefly ran back inside but returned moments later. The witness said she did not see anything in her stepfather’s hands before she fell or was pushed to the ground.

While she was on the ground, she heard two more shots. When she looked up, she saw Arocho had been struck.

Ocasio fled on foot immediately after the shooting. He was arrested the next day.

Suspect Claims He Fired Because He Felt Threatened

During his interview with detectives, Ocasio allegedly admitted to firing the shots that killed his father but insisted he acted out of fear.

He claimed Arocho came outside and “threatened him with a firearm,” asserting that he doesn’t “let anyone harm him.”

Ocasio told investigators he initially fired a “warning shot” because he believed his father was reaching for a gun. However, when asked if he actually saw a weapon, he admitted he did not see anything in his father’s hands.

“He fired two shots at his father, and he did not check on his father because he was scared and he just ran away,” police wrote.

Charges and Court Proceedings

Ocasio has been charged with first-degree homicide with a dangerous weapon modifier, one of the most serious charges under Wisconsin law. He is being held in the Milwaukee County Jail on a $100,000 cash-only bond.

A preliminary hearing is scheduled for Nov. 25, where a judge will determine whether enough evidence exists for the case to proceed to trial.
