In an exclusive video obtained by CBS News New York, a violent altercation unfolded on a New York City subway when a group of thieves allegedly targeted a sleeping passenger. The fight ended tragically, with one of the suspects losing his life.
What Happened: On December 22, just after midnight, a group of five men was traveling on the 7 train in Queens, headed towards Manhattan. The video from MTA security cameras shows the men stealing bags from a 69-year-old man who was asleep on the train. Once the victim woke up and noticed his bags were missing, he confronted the thieves. A fight broke out, and at least four of the suspects started attacking the victim, grabbing and punching him.
The Situation Escalates: The fight moved to another car on the subway. The victim’s bags were found under a seat, and it appeared that he reached into one of the bags. According to prosecutors, the victim then pulled out a weapon and stabbed two of the thieves. Tragically, one of the attackers died from the stabbing.
Victim Not Facing Charges: The victim, who is reportedly homeless, has not been charged with any crime. Prosecutors believe the man was simply trying to defend himself and get his belongings back. Queens District Attorney Melinda Katz stated, “We can’t stand for that in New York City. The subway system is way too important. It needs to be a safe space for everyone.”
The Suspects: The four surviving suspects—Henry Toapanta, Oswalo Walter, Jose Valencia, and Philipe Pena—have been charged with second-degree robbery and assault. Pena and Walter also face attempted gang assault charges.
David Bart, one of the defense attorneys, said, “They turned what would have been a regular robbery into something more serious because one of the suspects died. The victim chased them and killed one of them in self-defense.”
Susan Silverman, another defense attorney, defended her client, Jose Valencia, saying, “He didn’t play an aggressive role in the robbery and didn’t commit any assault.”
The Legal Outcome: All four suspects, who are between the ages of 26 and 32, have pleaded not guilty. They face up to 15 years in prison if convicted. The case is still ongoing, and the suspects will appear in court again soon.
