Former President Donald Trump wants a state court judge to throw out his New York hush money criminal charge. He says that because of a recent Supreme Court decision, he shouldn’t be punished for his role in meddling in the election.
Trump’s lawyers pointed to a recent decision by the U.S. Supreme Court that said the former president was not responsible for some of the actions that led to his election interference charges.
The justices voted 6-3 against Trump’s wider claims of full immunity but said he could not be charged for some of his duties as president.
This is a big win for our government and Constitution. “Thus I am Proud to Be an American,” Trump wrote on his social media site Truth Social after the decision.
Some Democrats didn’t agree with the decision and said it could have big effects on democracy and the president’s protection.
“No one is above the law,” President Joe Biden said after the high court’s decision. “Not even the president of the United States.”
“That changed fundamentally for all intents and purposes,” he said after the judge’s decision.
There are few chances for Trump to get his sentence thrown out, but because he is still fighting in court, his sentencing has been pushed back until September 18. It was supposed to happen on Thursday, but Judge Juan Merchan changed the date.
The lawyers for Trump have said that the former president can’t be charged in the New York case, and they say that Merchan is now “duty-bound” to follow the Supreme Court’s ruling on partial immunity.
