BOISE, Idaho— It was filed today in the US District Court for the Western District of Louisiana (Monroe Division) by the Defense of Freedom Institute for Policy Studies (DFI) and the States of Louisiana, Mississippi, Montana, and Idaho. The complaint is against the Biden administration’s final Title IX rules. The rules that were released today illegally change Title IX in a way that hurts students, teachers, parents, and schools by going against what it was meant to do and taking away rights that are guaranteed by the Constitution and other laws.
Lawyer General Raúl Labrador said, “I am very worried about how the Biden Administration is changing Title IX.” “Adding gender identity to the new definition of discrimination will have a huge effect on the progress Title IX has made for women and girls in our society.” With one move, the Biden Administration threatens decades of progress and chances for women while also making them deal with the humiliation of being around men in the bathrooms and locker rooms. The new rule breaks Title IX for these and many other reasons, and we are sure that we will win our court case.
Title IX strictly bars discrimination in schools based on “sex,” but the U.S. Department of Education’s new rules go against the law’s text and purpose by including “gender identity.” Aside from not fully defining the term “gender identity,” the Department also doesn’t explain the rules. This makes it impossible and harmful for schools to figure out what the Department means. Bathrooms, showers, and locker rooms that are separate for men and women are now illegal. This goes against Title IX and years of agency interpretation and police practice. There will also be violations of free speech and religious freedom because of the rules, which is bad for students, teachers, and schools.
