Florida Man on Trial for Murder in Death of Homeowner Killed by Police During Robbery

Orlando, FL – A Florida man is currently on trial for second-degree murder, burglary, and theft after a homeowner was killed by police officers during a reported robbery. Despite the fact that the police officers fired the fatal shots, it is Cristian Duran-Contreras, the accused, who is facing charges related to the death of Jose Luis Lopez.

The Alleged Incident

The tragic incident occurred on the night of February 8, 2024, at Lopez’s Orlando home. Authorities claim that when they arrived at the scene of a reported break-in, they found Duran-Contreras and Lopez in a struggle. Police believed Lopez was armed with a knife, but no weapon was recovered after the incident. Despite Lopez not being armed, police officers fired at him, killing him. The police have not been charged in the incident.

According to court documents, Duran-Contreras and Lopez, both roofers, had been drinking beer together at Lopez’s home earlier that evening. After tensions arose over the alcohol, Duran-Contreras became aggressive with Lopez, and a witness called an Uber for him, though the ride was canceled when Duran-Contreras failed to show up.

Around 11 p.m., Lopez reportedly called a woman, expressing concerns that someone was attempting to break into his home. The woman and Lopez both called 911, stating they saw someone loitering near a work truck, which turned out to be Duran-Contreras.

Police Response and Fatal Shooting

At just before midnight, deputies Alex Duran and Paul Ortiz arrived at the scene. Body camera footage shows the officers discovering a ladder propped up against the back of the home, leading to a window. Inside, Lopez was heard wailing in distress, and the officers claimed they saw him holding Duran-Contreras in a headlock.

The deputies, believing Lopez was armed with a knife, ordered him to drop the weapon. When Lopez did not comply, the deputies opened fire, hitting him in the head and killing him. No knife was ever found at the scene, contradicting the officers’ initial claims.

The Aftermath

Despite not firing the fatal shot, Duran-Contreras has been charged under Florida’s felony murder rule, which holds individuals responsible for deaths that occur during the commission of a felony, even if they did not directly cause the death. Duran-Contreras was later transported to the hospital with non-life-threatening injuries, and after speaking with investigators, he was released without charges at that time.

The officers involved were placed on temporary paid leave during the investigation by the Florida Department of Law Enforcement. They have since returned to full duty, as reported by the Orlando Sentinel.

Lack of Communication and Language Barriers

The body camera footage highlights the rapid escalation of events, with less than 10 seconds passing from the time the ladder entered the frame to when shots were fired. Lopez, speaking only Spanish, struggled to communicate with the officers, who did not have an interpreter present. Duran-Contreras, who also speaks Spanish, later stated that Lopez never had a knife and was trying to communicate with the deputies but could not understand them.

The incident has raised concerns in the Hispanic community of Pine Castle, where Lopez lived. The area is nearly 60% Hispanic, according to Census data, and many believe the lack of a language interpreter contributed to the tragic misunderstanding.

Calls for Justice and Community Impact

The family of Jose Luis Lopez has expressed frustration and sadness over his death. Lopez’s sister, Araceli, called for justice, saying, “If only they would have acted differently. We want justice.” A funeral for Lopez was held in Mexico in March 2024, where his family continues to seek answers regarding the circumstances of his death.

As the trial for Cristian Duran-Contreras continues in the Ninth Judicial Circuit Court, the community and Lopez’s family are left grappling with the complexities of the case and the broader issues surrounding police conduct and accountability.
